These Terms of Service (“Terms”) govern your use of the TrueCost website at truecost.care (the “Service”) operated by TrueCost (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or programmatically access the Service without our written consent
• Attempt to gain unauthorized access to our systems or other users’ accounts
• Resell, redistribute, or commercially exploit our pricing data without authorization
• Upload malicious files or content

4. Pricing Data and Medical Information

The pricing information provided by TrueCost is based on publicly available Medicare data and is intended for informational purposes only. See our Medical Disclaimer for important limitations.

We do not guarantee that any facility will accept the prices shown. Actual prices may vary based on individual circumstances, insurance coverage, facility policies, and other factors.

5. Beta Service

During the beta period, the Service is provided free of charge. We may modify, suspend, or discontinue any feature at any time. Beta features may contain bugs or produce inaccurate results. We provide the beta Service “as is” without warranties of any kind.

6. Future Paid Subscriptions

When paid subscription plans are introduced, we will provide advance notice to beta users. Billing terms, cancellation policies, and refund procedures will be detailed at that time. We will not charge your payment method without your explicit consent.

7. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted content and public government data), is owned by TrueCost and protected by applicable intellectual property laws. You retain ownership of any content you submit (e.g., uploaded bills).

8. Limitation of Liability

To the maximum extent permitted by law, TrueCost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold TrueCost harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at hello@truecost.care.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.
